ENROLLMENT & MEMBERSHIP AGREEMENT

This Creativ Rise Mastermind Enrollment & Membership Agreement (“Agreement”) is between Speers Collective LLC, a Delaware limited liability company doing business as Creativ Rise, with its principal place of business in Placer County, California (“Creativ Rise,” “Company,” “we,” “us,” or “our”) and the individual or business enrolling in the Creativ Rise Mastermind (“Member,” “you,” or “your”).
By enrolling in the Creativ Rise Mastermind, submitting payment, or checking the box indicating that you have read and agree to these terms, you acknowledge that you have read, understood, and agree to this Agreement.
Our goal with this Agreement is simple: to clearly explain what Creativ Rise is committing to provide, what you are committing to as a Member, how payments and membership work, and the requirements of our 5X Money-Back Guarantee.
1. THE CREATIV RISE MASTERMIND
The Creativ Rise Mastermind (“Mastermind”) is a twelve (12) month business coaching, education, implementation, and community program for creative business owners, including photographers, filmmakers, content creators, social media managers, agency owners, and other creative entrepreneurs.
The Mastermind is designed to help Members build stronger, more consistent, profitable, and sustainable creative businesses.
Our coaching and curriculum may cover areas including:
- Offers and pricing
- Brand positioning and messaging
- Lead generation
- Marketing and social funnels
- Pitching and outreach
- Sales
- Client experience
- Business systems and operations
- Financial management
- Team building and scaling
- Goal setting
- Business planning and strategy
Creativ Rise provides business education and coaching. We do not provide legal, tax, accounting, investment, financial, or other regulated professional advice.
You remain responsible for your own business decisions and for determining whether a particular strategy, recommendation, template, or resource is appropriate for your business.
2. WHAT YOUR MEMBERSHIP INCLUDES
Your initial Mastermind membership includes twelve (12) months of access to the Creativ Rise Mastermind.
Your First Month: The Creativ Rise Sprint
Your first month includes an intensive onboarding and implementation experience designed to establish or strengthen the foundations of your business.
The Sprint focuses on areas such as:
- Offers
- Pricing
- Positioning
- Lead generation
- Marketing
- Sales
- Business strategy
Your Ongoing Mastermind Membership
Throughout your membership, you may receive access to:
- Live coaching and strategy sessions
- Growth workshops
- Six-Week Roadmap planning sessions
- Accountability and implementation support
- The Creativ Rise community
- On-demand educational modules
- Creativ Rise frameworks and curriculum
- The Creativ Rise Toolkit Vault
- Templates, calculators, scripts, guides, worksheets, AI tools, GPTs, and other business resources
- Additional resources, events, or benefits Creativ Rise makes available to Members
Specific schedules, coaches, platforms, resources, and session formats may evolve as we continue improving the Mastermind.
Creativ Rise may reasonably modify, replace, reschedule, improve, or discontinue individual components when necessary, provided that the overall substance and value of the Mastermind are not materially diminished.
Coaching may be provided by Joey Speers, Christy Speers, other Creativ Rise team members, designated coaches, or guest experts.
Enrollment does not guarantee any particular amount of individual or one-on-one access to Joey, Christy, or any other specific person unless that access is expressly included in the offer you purchased.
3. YOUR INITIAL 12-MONTH COMMITMENT
When you join the Creativ Rise Mastermind, you are committing to an initial twelve (12) month membership.
If you choose a monthly payment plan, you are not purchasing the Mastermind one month at a time.
The payment plan is simply a way to divide your total commitment into scheduled payments.
By enrolling, you agree to complete the payment plan you selected.
Your payment commitment remains in place regardless of whether you:
- Attend every live call
- Complete every module
- Participate consistently in the community
- Use every resource
- Decide to stop participating
- Experience changes in your schedule, business, or financial circumstances
Stopping participation does not automatically cancel your remaining payments.
Except where expressly permitted under our 5X Money-Back Guarantee or required by applicable law, you remain responsible for completing your agreed payment schedule.
4. INVESTMENT AND PAYMENT OPTIONS
Your Mastermind investment is the price presented and accepted by you at checkout or contained in a written custom payment arrangement approved by Creativ Rise.
Our standard payment options may include:
Monthly Payment Plan
$1,997 upon enrollment, followed by eleven (11) monthly payments of $297.
Total first-year investment: $5,264.
Pay-in-Full
$4,497 upon enrollment.
This covers your initial twelve-month Mastermind membership.
Creativ Rise may offer promotional pricing or approve alternative payment arrangements.
If we approve a custom payment schedule for you in writing, that schedule controls your payment amounts and timing. Unless we specifically agree otherwise in writing, changing when payments are made does not change your overall financial commitment.
Automatic Billing
If you choose a payment plan, your payments are processed automatically through our checkout and payment platform.
By enrolling, you authorize Creativ Rise and its payment processors to automatically charge the payment method you provide according to the payment schedule disclosed and accepted at checkout.
You do not need to manually submit each monthly payment.
5. FAILED OR LATE PAYMENTS
You are responsible for maintaining a valid payment method on file.
If a scheduled payment fails, Creativ Rise or its payment processor may attempt to process the payment again and may contact you to update your payment information.
If your account becomes past due, we may temporarily pause your access to Mastermind calls, workshops, community spaces, educational materials, recordings, tools, and other resources until your account is brought current.
Pausing access because of an unpaid balance does not cancel the balance owed under your payment agreement.
If an outstanding balance remains unpaid, Creativ Rise reserves the right to pursue reasonable collection efforts and other remedies available under applicable law.
6. WHAT HAPPENS AFTER YOUR FIRST 12 MONTHS
After completing your initial twelve-month commitment, your Mastermind membership will automatically continue on a month-to-month basis at $297 per month, unless you cancel.
There is no new twelve-month commitment after your first year unless you separately agree to one.
Your payment method on file will automatically be charged $297 each month while your continuing membership remains active.
After completing your initial twelve-month term, you may cancel your month-to-month membership at any time before your next renewal charge using the cancellation method provided by Creativ Rise.
Cancellation stops future renewal charges. It does not retroactively refund payments that have already been properly processed or cancel unpaid amounts from your initial twelve-month commitment.
Creativ Rise will provide renewal disclosures, notices, and cancellation options as required by applicable law.
7. CANCELLATIONS AND REFUNDS
Because the Mastermind provides immediate and ongoing access to coaching, community, curriculum, intellectual property, digital resources, tools, templates, frameworks, and other benefits, payments are generally non-refundable.
Except for a valid claim under the 5X Money-Back Guarantee in Section 10 or where otherwise required by law, refunds will not be provided because you:
- Change your mind
- Decide the Mastermind is no longer a priority
- Do not have time to participate
- Do not attend calls or workshops
- Do not complete the curriculum
- Do not use the community or resources
- Experience changes in your personal, business, or financial circumstances
- Do not achieve a particular business result
Creativ Rise is responsible for providing the Mastermind substantially as represented.
You are responsible for participating, implementing, and operating your business.
8. YOUR RESPONSIBILITIES AS A MEMBER
The Mastermind is an implementation-based coaching program.
We can give you strategy, coaching, tools, accountability, feedback, and support. We cannot implement those things in your business for you.
As a Member, you are responsible for:
- Participating in the Mastermind
- Reviewing applicable educational materials
- Implementing strategies appropriate to your business
- Completing relevant implementation work
- Taking consistent action
- Asking for help when you get stuck
- Making your own business decisions
- Tracking your business performance
- Maintaining appropriate business and financial records
- Treating the Creativ Rise team and other Members respectfully
- Protecting confidential information shared within the Mastermind
Creativ Rise is responsible to you, but we cannot be responsible for you.
9. BUSINESS RESULTS AND EARNINGS
We believe strongly in what we teach and have seen Creativ Rise Members achieve significant business results.
However, every business and every Member is different.
Except for the specific 5X Money-Back Guarantee described below, Creativ Rise does not guarantee any particular amount of revenue, profit, clients, bookings, leads, business growth, or other financial result.
Testimonials, case studies, Member revenue numbers, statistics, and success stories represent individual experiences. They do not mean every Member will achieve the same results.
Your results depend on factors including your starting point, experience, market, services, pricing, positioning, skill, implementation, consistency, sales ability, available resources, economic conditions, and the decisions you make.
10. 5X MONEY-BACK GUARANTEE
We stand behind the Creativ Rise Mastermind with a 5X Money-Back Guarantee.
The idea is simple:
Do the work. Use the coaching. Implement what we teach. If you meet the requirements below and still don’t generate at least 5X your Mastermind investment in qualifying projected revenue, we’ll stand behind the program.
To qualify for the 5X Money-Back Guarantee, you must meet all five requirements below during your initial twelve months.
Requirement 1: Ask for Help in the Community
When you encounter a meaningful challenge, obstacle, or area where you need direction, you must ask for help through the designated Creativ Rise Mastermind community platform.
The purpose of this requirement is to give our team an opportunity to help you solve problems while there is still time to do something about them.
You cannot remain disengaged when you are struggling and then claim the guarantee at the end of your membership without having given Creativ Rise a reasonable opportunity to help.
Questions and requests for support made through the designated community platform will count toward this requirement and may be verified through community records.
Requirement 2: Attend at Least 21 Live Calls
You must attend at least twenty-one (21) live Creativ Rise Mastermind calls during your initial twelve-month membership.
Eligible calls may include:
- Mastermind coaching calls
- Sprint calls
- Workshops
- Six-Week Roadmap sessions
- Other live Mastermind coaching or educational sessions designated by Creativ Rise
For purposes of the guarantee, watching a replay does not count as live attendance.
Requirement 3: Invest $1,000 in Paid Advertising If Prescribed
If paid advertising is prescribed by Creativ Rise as part of your business strategy, you must spend at least $1,000 USD in paid advertising during a consecutive three (3) month period within your initial twelve-month membership.
If Creativ Rise does not prescribe paid advertising as part of your strategy, this requirement does not apply to you.
The advertising should be implemented in connection with your creative business as part of a reasonable effort to generate awareness, leads, inquiries, or sales.
If this requirement applies to you, you must be able to provide reasonable documentation of the advertising spend through advertising-platform records, receipts, invoices, or similar records.
Requirement 4: Complete More Than 50% of the Mastermind Modules
You must complete more than fifty percent (50%) of the designated Creativ Rise Mastermind educational modules available to you during your initial twelve-month membership.
Completion may be verified through our learning platform or other Creativ Rise records.
Requirement 5: Complete at Least 70% of Your Six-Week Roadmaps
You must participate in, plan, and make a genuine effort to execute at least seventy percent (70%) of the Six-Week Roadmap cycles offered during your initial twelve-month membership.
Because enrollment dates and the calendar may affect the exact number of cycles available during a Member’s twelve months, this requirement is based on percentage rather than a fixed number.
For example:
- If 8 Roadmap cycles are offered during your membership, you must complete at least 6.
- If 9 Roadmap cycles are offered during your membership, you must complete at least 7.
For a Roadmap cycle to count, you must:
- Participate in the planning process
- Establish your goals and Wagers
- Create your six-week execution plan
- Make a genuine effort to execute your Wagers and planned actions
Simply creating a Roadmap without making a reasonable effort to execute it does not count as completing the cycle.
How We Calculate Your 5X Result
For purposes of the guarantee, we look at qualifying projected revenue generated during your initial twelve-month Mastermind term, not only cash that has already been collected.
This means that legitimate business contracted or booked during your initial twelve months can count toward your 5X result even when some or all of the associated payments will be received after your twelve-month membership ends.
For example:
If you sign a legitimate $25,000 twelve-month client retainer during Month 11 of the Mastermind, the full $25,000 contracted value may count toward your 5X result, even though much of that money will be collected after your initial Mastermind term ends.
Qualifying projected revenue may include:
- Signed client contracts
- Signed retainers
- Confirmed and contracted projects
- Booked services
- Other legitimate, reasonably verifiable business revenue contractually committed during your initial twelve-month term
A verbal possibility, unaccepted proposal, uncommitted lead, sales pipeline estimate, or opportunity that has not been legitimately booked or contracted does not count as projected revenue.
Projected revenue must be reasonably verifiable through contracts, accepted proposals, invoices, booking records, payment schedules, or similar business documentation.
If a contract contains optional extensions, conditional amounts, performance bonuses, or other revenue that is not yet committed, only the committed portion will count.
Your 5X Threshold
Your threshold is based on the actual Mastermind price applicable to your enrollment.
For example:
If your Mastermind investment is $5,264, your 5X threshold is $26,320.
If your Mastermind investment is $4,497, your 5X threshold is $22,485.
If you joined under promotional pricing or another approved price, your 5X threshold is five times the applicable Mastermind price you agreed to pay.
Documentation
If you submit a guarantee claim, we may reasonably request documentation necessary to verify that you met the five requirements and determine the qualifying projected revenue generated during your membership.
This may include:
- Mastermind attendance records
- Module completion records
- Six-Week Roadmaps and Wagers
- Community questions or requests for support
- Advertising records, if applicable
- Client contracts
- Accepted proposals
- Booking records
- Invoices
- Payment schedules
- Bookkeeping or accounting records
- Other reasonable records necessary to verify your participation and results
Making a Claim
Guarantee claims must be submitted in writing within thirty (30) days following completion of your initial twelve-month Mastermind term.
If you:
- Satisfied all five applicable requirements;
- Submit the reasonably requested documentation; and
- Did not generate qualifying projected revenue equal to at least 5X your Mastermind investment,
Creativ Rise will refund the qualifying Mastermind fees you paid.
Failure to satisfy an applicable eligibility requirement means you will not qualify for this voluntary 5X Money-Back Guarantee.
Nothing in this guarantee limits rights that cannot legally be waived under applicable law.
11. INTELLECTUAL PROPERTY
The curriculum, frameworks, tools, training, and resources we create are an important part of Creativ Rise.
All Creativ Rise Mastermind materials and intellectual property remain the property of Speers Collective LLC, Creativ Rise, our licensors, or their respective owners.
This includes things such as:
- Videos and recordings
- Curriculum and training
- Frameworks and methodologies
- Presentations and workbooks
- Guides
- Templates
- Calculators and spreadsheets
- Scripts
- Sales and pricing frameworks
- AI tools
- GPTs, instructions, and prompts
- Community resources
- Written materials and graphics
Your membership gives you permission to use these resources for your own business.
It does not transfer ownership of our intellectual property to you.
Unless we give you written permission, you may not:
- Sell or redistribute Mastermind materials
- Share paid resources with non-members
- Share your membership login or access
- Upload paid resources publicly
- Copy or publish our proprietary curriculum
- Present Creativ Rise curriculum or frameworks as your own
- Package or resell Creativ Rise materials in another course, coaching program, membership, or product
- Reproduce, distribute, sublicense, or sell derivative copies of Creativ Rise proprietary materials
You may customize resources specifically designed for use in your own business, such as client-facing templates, scripts, calculators, or contracts.
The goal here is simple: use what we give you to grow your business. Don’t copy it and sell it as your own.
12. COMMUNITY CONFIDENTIALITY
The value of the Mastermind depends partly on Members being able to have real conversations about their businesses.
Members may discuss revenue, pricing, clients, leads, sales, strategies, challenges, financial information, and personal experiences.
Please treat those conversations as confidential.
You may not record, screenshot, reproduce, publish, distribute, or publicly share another Member’s confidential business or personal information without their permission.
Information shared by another Member remains theirs.
Creativ Rise cannot guarantee that every Member will follow these requirements, so you should still use reasonable judgment when sharing highly sensitive information.
13. MEMBER CONDUCT
We want the Mastermind to remain a respectful, ambitious, collaborative environment.
Creativ Rise may suspend or remove a Member for serious or repeated behavior including:
- Harassment, threats, discrimination, or abusive behavior
- Repeated disruption
- Inappropriate solicitation or spam
- Sharing confidential Member information
- Unauthorized sharing or distribution of Creativ Rise materials
- Sharing membership credentials
- Fraudulent or illegal activity
- Material violations of this Agreement
Where reasonable, we’ll first give you an opportunity to correct an issue.
Serious misconduct may result in immediate removal.
Removal because of a material violation does not automatically create a right to a refund or cancel legitimate outstanding payment obligations.
14. RECORDING OF MASTERMIND SESSIONS
Mastermind calls, workshops, roadmap sessions, coaching sessions, and other live events may be recorded.
Recordings may be made available to current or future Mastermind Members for educational purposes.
By participating in a recorded session, you understand that your name, voice, video, chat messages, questions, comments, screens voluntarily shared, or other participation may appear in the recording.
We may also provide additional recording notices through the video-conferencing platform or at the beginning of a session.
If you do not want your image or voice included, you may keep your camera off and use available written participation methods where reasonably practical.
15. TESTIMONIALS AND MEMBER SUCCESS STORIES
We love celebrating Member wins.
If you voluntarily give Creativ Rise a testimonial, review, success story, screenshot, photograph, video testimonial, interview, written statement, or similar material for the purpose of sharing your experience, you give Creativ Rise permission to use that material in our marketing and educational content.
We may edit it for length, formatting, grammar, or presentation, but we will not knowingly change its meaning or falsely attribute results or statements to you.
For larger case studies, interviews, or promotional features, we may separately ask for your participation or permission.
16. THIRD-PARTY PLATFORMS
We use third-party services to operate portions of the Mastermind, including services for payments, video calls, community, educational content, AI functionality, communications, scheduling, and file storage.
We don’t control third-party outages, policy changes, or technical failures.
If a platform becomes unavailable or impractical, we may move the affected part of the Mastermind to a reasonably comparable alternative.
17. TEMPLATES, CONTRACTS, CALCULATORS, AND AI TOOLS
Some Mastermind resources may include sample contracts, agreements, financial tools, calculators, AI tools, GPTs, prompts, scripts, or templates.
These are educational resources, not individualized legal, tax, accounting, financial, or other professional advice.
You are responsible for determining whether a resource is appropriate for your particular business and jurisdiction and for consulting an appropriate professional when necessary.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Speers Collective LLC, Creativ Rise, and their owners, employees, contractors, coaches, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your participation in the Mastermind or use of Mastermind materials.
This includes things such as lost profits, lost revenue, lost opportunities, lost clients, business interruption, or business decisions you make based on Mastermind education.
To the fullest extent permitted by applicable law, the total liability of Speers Collective LLC and Creativ Rise arising from this Agreement or your Mastermind membership will not exceed the amount you actually paid to Creativ Rise for the applicable Mastermind membership term.
Nothing in this Agreement excludes liability that cannot legally be excluded or limited.
19. EVENTS OUTSIDE OUR CONTROL
Creativ Rise will not be considered in breach of this Agreement for reasonable delays, cancellations, or interruptions caused by circumstances outside our control.
Examples include natural disasters, serious illness, emergencies, internet or technology failures, platform outages, government actions, and failures of third-party service providers.
Where reasonably practical, we’ll make a good-faith effort to reschedule materially affected programming or provide a reasonable alternative.
20. GOVERNING LAW AND DISPUTES
This Agreement is governed by the laws of the State of California, without regard to its conflict-of-law principles.
Before either party begins formal legal proceedings, you and Creativ Rise agree to make a good-faith effort to resolve the issue directly.
If a dispute cannot be resolved informally, any legal action arising from this Agreement or the Creativ Rise Mastermind will be brought in an appropriate state or federal court having jurisdiction over Placer County, California, and each party consents to the jurisdiction and venue of those courts.
Nothing in this Agreement limits rights or remedies that cannot legally be waived.
21. ELECTRONIC ACCEPTANCE
Checking the agreement box and completing enrollment constitutes your electronic acceptance of this Agreement.
You agree that electronic acceptance has the same legal effect as a handwritten signature to the extent permitted by applicable law.
You also consent to receiving notices concerning your Mastermind membership electronically using the contact information associated with your account.
22. CHANGES TO THIS AGREEMENT
The version of this Agreement you accept when you enroll governs your initial twelve-month membership.
Creativ Rise may update its terms for future enrollments or future renewal periods.
If a material change affects an existing continuing membership, we will communicate that change as required by applicable law.
23. ENTIRE AGREEMENT
This Agreement, together with the checkout terms and any specific written payment arrangement or enrollment offer you accept, constitutes the agreement between you and Creativ Rise regarding your Mastermind membership.
If a written custom payment arrangement conflicts with this Agreement specifically regarding price or payment timing, the approved custom arrangement controls for that issue.
If one part of this Agreement is determined to be invalid or unenforceable, the remainder of the Agreement will continue to apply to the fullest extent permitted by law.
24. WHAT YOU’RE AGREEING TO
By checking the box and enrolling in the Creativ Rise Mastermind, you acknowledge that:
- You have read and agree to this Agreement.
- Your initial Mastermind commitment is twelve months.
- A monthly payment plan is a payment schedule, not a month-to-month membership during your initial term.
- You agree to complete your selected payment schedule.
- Your membership automatically continues at $297/month after your initial twelve months unless you cancel.
- You authorize the recurring charges disclosed at checkout.
- Mastermind payments are generally non-refundable except under the 5X Money-Back Guarantee or as otherwise required by law.
- The 5X Money-Back Guarantee has specific participation and implementation requirements.
- Projected contracted or booked revenue may count toward your 5X result even when it has not yet been collected.
- Business results vary.
- Creativ Rise cannot operate or implement your business for you.
- Mastermind sessions may be recorded.
- Creativ Rise intellectual property remains the property of Creativ Rise and Speers Collective LLC.
- You agree to respect the confidentiality of other Members.
- You voluntarily agree to be bound by these terms.
